It is not very clearly defined whether a VPN falls under this rule. In any case, you are most likely breaking the terms and conditions and running the risk of being temporarily or permanently banned from Netflix. And what does the copyright law say? Paragraph 95a stipulates that effective technical measures to protect a work may not be circumvented without the consent of the rights holder. So whoever circumvents the blockage via VPN is also acting illegally?
